Privacy Policy

PRIVACY POLICY

Everest Global Group respects your privacy. This Privacy Policy explains what we collect and how we use

it.

16.1 Information We Collect. We may collect: name, email address, phone number, billing and payment

information, course enrollment information, website usage data, device and browser information, and

communications you submit to us.

16.2 How We Use Information. Information may be used to deliver services, process payments, provide

support, communicate with students, improve our services, maintain business records, and comply with

legal obligations.

16.3 Cookies, Analytics & Tracking. Our Website may use cookies, pixels, tags, and similar

technologies, including third-party analytics and advertising tools, to operate the site, remember

preferences, measure traffic and performance, and improve our services. These tools may collect

information such as IP address, pages visited, time on site, referral source, and device or browser details.

You can control or disable cookies through your browser settings, though some site features may not

function properly without them. Where required by law, we will request consent before placing non-

essential cookies.

16.4 Data Retention. We retain personal information for as long as needed to provide services, maintain

business and financial records, resolve disputes, and comply with legal, tax, and regulatory obligations.

When information is no longer required, we take reasonable steps to delete or anonymize it.

16.5 Your Privacy Rights. Depending on your jurisdiction, you may have the right to request access to,

correction of, or deletion of the personal information we hold about you, and to opt out of certain uses. To

make a request, contact us at the address in Section 28. We will respond within the timeframe required

by applicable law and may need to verify your identity before fulfilling a request.

16.6 No Services to Minors. Our Website, programs, and services are intended solely for individuals 18

years of age or older. We do not knowingly collect personal information from anyone under 18. If we learn

that we have collected information from a person under 18, we will delete it. By enrolling or using our

services, you represent that you are at least 18 years old.

16.7 Third-Party Links. Our Website and materials may contain links to third-party websites and

platforms (such as LinkedIn, payment processors, and learning or lab providers). We are not responsible

for the content, privacy practices, or security of any third-party site. We encourage you to review the

privacy policies of any third party you interact with.

16.8 Email & SMS Communications. By providing your email address or phone number, you consent to

receive transactional and service-related messages relating to your enrollment, payments, and course

access. With your consent where required, we may also send promotional or informational messages.

You may opt out of marketing messages at any time by following the unsubscribe instructions in an email

or replying STOP to a text message; you may continue to receive non-promotional messages necessary

to administer your enrollment. Message and data rates may apply.

16.9 Data Sharing. We do not sell personal information to third parties. Information may be shared with

payment processors, service providers, and legal authorities when required by law. You acknowledge that

no online system can guarantee absolute security.

16.10 Changes to This Policy & Effective Date. This Privacy Policy is effective as of the "Last Updated"

date shown at the top of this document. We may update it at any time, and changes become effective

upon posting to the Website. Material changes will be reflected by updating the "Last Updated" date. Your

continued use of our services after changes are posted constitutes acceptance of the revised policy.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

Insight Scholars LLC, Everest Global Group, its owners, contractors, affiliates, employees, instructors,

agents, and representatives shall not be liable for any indirect, incidental, consequential, special, punitive,

or exemplary damages.

Maximum liability shall not exceed the amount paid by the student for the specific service giving rise to

the claim.

18. INDEMNIFICATION

Users agree to indemnify and hold harmless Insight Scholars LLC and Everest Global Group from any

claims, damages, liabilities, losses, costs, expenses, or attorney fees arising from website use, service

use, violation of these Terms, misuse of training materials, or intellectual property violations.

19. DISPUTE RESOLUTION

Any dispute arising from or relating to these Terms, the Website, enrollment, services, or any transaction

shall first be addressed through good-faith negotiation between the parties. Any dispute not resolved

within thirty (30) days shall be submitted to final and binding arbitration administered by the American

Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. Arbitration shall be

seated in the Commonwealth of Virginia, and judgment on the award may be entered in any court of

competent jurisdiction. Each party shall bear its own attorneys’ fees except where applicable law or the

AAA rules provide otherwise; filing and arbitration fees shall be allocated as required by the AAA

Consumer Arbitration Rules. This provision does not prevent either party from seeking relief in small

claims court for disputes within that court’s jurisdiction.

20. GOVERNING LAW

These Terms shall be governed exclusively by the laws of the Commonwealth of Virginia without regard

to conflict-of-law principles.

21. CLASS ACTION WAIVER

Users agree that disputes shall be brought solely on an individual basis. Users waive any right to

participate in class actions, collective actions, or representative proceedings to the fullest extent permitted

by law.

22. MODIFICATIONS

Everest Global Group may modify these Terms at any time. Updated versions become effective

immediately upon posting to the Website. Continued use of services constitutes acceptance of revised

Terms.

23. SEVERABILITY

If any provision of these Terms is held invalid, unlawful, or unenforceable by a court or arbitrator of

competent jurisdiction, that provision shall be severed and the remaining provisions shall remain in full

force and effect. Any severed provision shall be replaced, to the extent permitted by law, by an

enforceable provision that most closely reflects the original intent.

24. FORCE MAJEURE

Everest Global Group shall not be liable for any delay, interruption, or failure to provide services or

access caused by events beyond its reasonable control, including but not limited to acts of God, natural

disasters, power or internet outages, platform or hosting failures, third-party vendor or software failures,

cyberattacks, labor disputes, or governmental action. In such cases the Company will make reasonable

efforts to restore services but shall not be obligated to issue refunds beyond what Section 8 provides.

25. ENTIRE AGREEMENT; NO ORAL REPRESENTATIONS

These Terms, together with the Privacy Policy, Refund Policy, Disclaimers, and Student Enrollment

Agreement, constitute the entire and complete agreement between the student and Everest Global Group

regarding the services, and supersede all prior or contemporaneous communications, representations,

understandings, or agreements, whether written or oral.

The student acknowledges that no statement, promise, assurance, or representation — whether made

verbally, in marketing materials, during instruction, in coaching or mentoring sessions, or in any informal

communication — regarding employment, interviews, certifications, salary, job placement, or any specific

outcome forms part of this agreement or is binding on the Company unless expressly stated in writing

within these Terms.

Routine instructional, scheduling, and support matters may continue to be handled informally and verbally

in the ordinary course of the student-teacher relationship; this Section governs only the legal terms of the

agreement and the existence of binding representations.

26. THIRD-PARTY PLATFORMS & SERVICES

Services may be delivered through or depend upon third-party platforms, including learning management

systems, video hosting, lab and software providers, and payment processors. Everest Global Group does

not control and is not responsible for the availability, performance, security, or conduct of such third

parties. Interruptions, errors, or failures attributable to a third-party platform do not constitute a breach by

the Company and are addressed under Sections 8 and 24.

27. CONTACT & LEGAL NOTICE

Any refund request, legal notice, privacy request, or dispute notification under these Terms must be

submitted in writing to:

Notices are effective upon receipt. The Company may provide notices to students at the email address

associated with their enrollment.

28. STUDENT ENROLLMENT AGREEMENT

By enrolling in any Everest Global Group program and completing payment, the student acknowledges

and agrees that:

✓ I have read and agree to these Terms & Conditions.

✓ I understand that I may cancel for a full refund at any time before Access to any materials occurs, and

that all sales are final once Access has occurred.

✓ I understand that employment is not guaranteed.

✓ I understand that interviews are not guaranteed.

✓ I understand that certifications are not guaranteed.

✓ I understand that salary outcomes are not guaranteed.

✓ I understand that installment plans remain fully payable after Access occurs.

✓ I agree not to copy, distribute, record, or share Company materials.

✓ I understand that Everest Global Group provides educational services only.

✓ I understand that individual results vary.

✓ I understand that no verbal or marketing statement about outcomes is binding unless stated in writing

in these Terms.

✓ I consent to these Terms, Privacy Policy, Refund Policy, Disclaimers, and Enrollment Agreement.
